Art. 2. What is Expatio

2.1. Expatio is an information society service through which people from the community of Romanians settled abroad can publish and consult information, communicate with each other, and connect in order to conclude their own legal relationships.

2.2. The platform provides the following functionalities:

1. a community feed, where users publish posts, comments, and reactions;

2. a job listings section (Joburi), with subsections for those offering and those looking for a job;

3. a housing section (Chirii);

4. a section for services offered by community members (Servicii);

5. an events section (Evenimente);

6. a transport section (Transport), through which offers and requests for passenger and parcel transport between countries are published;

7. a private messaging system between users, which includes the possibility to initiate audio and video calls between accounts without using phone numbers;

8. a rating and review system;

9. content filtering and sorting, including by distance from the user's location;

10. a paid ad promotion service, described in chapter VI.

2.3. The Operator acts as a hosting service provider and online platform provider within the meaning of article 3 letters g) point iii) and i) of Regulation (EU) 2022/2065. The Operator stores and makes available to the public information provided by users, without generating, editing, or adopting it.

Art. 3. What Expatio is not

3.1. The Operator is not a party to the legal relationships that arise between users. Employment contracts, rental agreements, service provision agreements, transport agreements or any other understandings are concluded exclusively between users, at their own risk, and the Operator does not act as an employer, employment placement agency, real estate agent, carrier, freight forwarder, commission agent, travel organizer or insurance intermediary.

3.2. The Operator does not pre-verify the identity of users, the truthfulness of advertisements, the existence of necessary authorizations, the quality of goods or services offered, the solvency of the parties or the execution of agreements between them. Badges displayed on the platform, such as the indication of holding a transport license or highlighting accounts with a good history, reflect information declared by users or automated calculations based on platform activity, rather than an independent verification performed by the Operator, unless expressly stated otherwise.

3.3. The Operator does not collect the price of services or goods traded between users, does not hold funds on their behalf and does not offer payment services. The only amounts collected by the Operator are those related to ad promotion services.

3.4. General information published by the Operator regarding administrative formalities, residence, work or other procedures does not constitute legal, tax, medical or financial advice.

CHAPTER II. ACCEPTANCE AND ACCOUNT

Art. 5. Acceptance of the Terms

5.1. Accessing the platform, creating an account, publishing content or purchasing a promotion service imply reading and full acceptance of these Terms. If you do not agree with any provision, do not use the platform.

5.2. The Terms, together with the Privacy Policy on the processing of personal data and the Cookie Policy, form the contract between you and the Operator. In case of discrepancies between the documents, the one offering more favorable protection to the consumer user shall prevail.

5.3. The contract is concluded in Romanian. The platform interface is also available in other languages; in case of divergence between language versions, the Romanian version shall prevail, unless the mandatory law of the consumer's state of residence provides otherwise.

5.4. The contract is electronically archived by the Operator and remains accessible at https://expatio.ai/termeni. You can save or print this document at any time.

Art. 6. Age and capacity

6.1. The platform is intended for individuals who are at least 18 years old and have full legal capacity.

6.2. Individuals who are at least 16 years old, but under 18 years old, may create an account and use the communication features only with the prior consent of their legal representative and without publishing ads, without concluding transactions, and without purchasing promotion services. The Operator may request proof of consent and may close the account in its absence.

6.3. Creating an account by an individual under 16 years old is prohibited.

Art. 7. Account Creation and Administration

7.1. The account is created by following the steps indicated in the interface, starting with the e-mail address. Authentication is performed via the e-mail address and, where applicable, through a single-use code sent to it or via a password.

7.2. You undertake to provide real, complete, and current information and to update it whenever it changes.

7.3. The account is personal and non-transferable. You are responsible for maintaining the confidentiality of access data and for all operations performed through your account. Notify us without delay at [email protected] if you suspect unauthorized access.

7.4. Creating multiple accounts by the same person in order to evade a suspension measure, manipulate reviews, artificially increase visibility, or mislead other users is prohibited.

7.5. You may close the account at any time, from the settings or through a request sent to [email protected]. Closing the account does not affect previously incurred obligations, in particular due payment obligations, and does not automatically determine the deletion of content that is the subject of a notification, a procedure, or a legal retention obligation.

7.6. The Operator may delete accounts that remain inactive for a period of 24 months, after a prior email notification sent at least 30 days in advance.

CHAPTER III. RULES OF USE AND CONTENT

Art. 8. General obligations of the user

8.1. Use the platform in good faith, in compliance with the applicable law in Romania, in your state of residence, and in the state where the effects of the activity you announce take place.

8.2. You ensure that you hold the necessary rights over the content you publish and that publication does not violate the rights of third parties.

8.3. Do not use the platform to mislead, to obtain undue benefits, or to evade legal obligations.

Art. 9. Prohibited content and behavior

9.1. It is forbidden to publish or transmit through the platform the following:

1. content that constitutes a crime or misdemeanor, that incites violence, hatred, or discrimination based on race, nationality, ethnicity, language, religion, social category, beliefs, sex, sexual orientation, age, disability, non-contagious chronic illness, HIV infection, or belonging to a disadvantaged category, within the meaning of Government Ordinance no. 137/2000;

2. terrorist content, materials regarding child sexual abuse, or any other illegal content within the meaning of Regulation (EU) 2022/2065;

3. personal data of other persons, published without legal basis, including phone numbers, addresses, photographs, or health information of third parties;

4. content that violates intellectual property rights, trademarks, designs, models, or trade secrets;

5. offers regarding goods or services whose commercialization is prohibited or subject to a special regime that you do not comply with: narcotic substances, weapons, ammunition, explosive materials, counterfeit products, prescription drugs, official documents, sexual services, animals whose commercialization is restricted;

6. fake job offers, pyramid schemes, offers that condition employment on paying an upfront fee, offers that hide the identity of the real employer or involve human trafficking or undeclared work;

7. content requesting upfront payments to personal accounts, in cryptocurrencies or through rapid money transfer services, as a condition for receiving a job, housing or transportation;

8. repeatedly sent unsolicited commercial messages, duplicate content published for the artificial increase of visibility, the use of automated means for publishing, voting or rating;

9. fake reviews, bought reviews, reviews given by accounts controlled by the same person or reviews given in the absence of a real interaction;

10. content of an obscene or violent nature, gratuitous or unjustified by the context;

11. attempts at unauthorized access to systems, automated data extraction, testing vulnerabilities without the written consent of the Operator, transmission of malicious computer programs.

9.2. The Operator may remove content that violates the preceding paragraph, may limit its visibility, may suspend the account or may terminate the provision of the service, under the conditions of chapter VIII.

Art. 10. Rights regarding published content

10.1. You retain all rights to the content you publish.

10.2. By publishing, you grant the Operator a non-exclusive, free, transferable within the chain of service providers, worldwide valid license to host, store, reproduce, technically adapt, display and publicly communicate the content, exclusively for the purpose of providing, promoting and improving the platform.

10.3. The license terminates upon the removal of the content, with the following exceptions: existing back-up copies, for the period indicated in the Information Note; content previously taken over or redistributed by other users; content that must be kept for the performance of a legal obligation or for the defense of a right.

10.4. The name Expatio, the name Beta-Group, the logos, graphic elements, structure, source code and databases of the platform belong to the Operator or its licensors and are protected by Law no. 8/1996 regarding copyright and related rights, by Law no. 84/1998 regarding trademarks and geographical indications and by the provisions regarding database protection. Their use without written agreement is prohibited.

10.5. The systematic extraction or reuse of a substantial part of the platform's content, by any means, including automated ones, is prohibited.

Art. 11. Notification of intellectual property rights infringement

11.1. The holder of a right who considers that published content infringes their rights may send a notification to [email protected], indicating: the identification of the invoked right and proof of ownership; the exact location of the contested content, via the web address; the reasons why the content is considered illegal; the contact details of the notifier; the declaration regarding good faith and the accuracy of the information.

11.2. The notification is resolved according to the procedure in article 27.

CHAPTER IV. SPECIFIC RULES BY AD CATEGORIES

Art. 12. Common rules for all ads

12.1. The ad is published in the appropriate category, with an exact description, price or price range when known, and with the indication of the locality.

12.2. When publishing an ad, you declare whether you are acting as a professional or as an individual who does not carry out a commercial activity. The declaration is displayed to other users. This obligation implements Article 6 paragraph (1) of Government Emergency Ordinance no. 34/2014, as amended by Government Emergency Ordinance no. 58/2022, according to which the consumer must be informed whether the third party offering the goods or services has the status of a professional or not.

12.3. When the counterpart is not a professional, consumer protection rules do not apply to the relationship between users. The consumer contracting with a person who does not have the status of a professional does not benefit from the right of withdrawal, the legal guarantee of conformity, and other rights provided by consumer protection legislation.

12.4. Professionals who publish ads have the obligation to provide, at the request of the Operator, the information provided in Article 30 of Regulation (EU) 2022/2065: name, address, telephone number, and e-mail address; a copy of the identification document or another means of electronic identification; payment account details; the trade register where they are registered and the registration number; self-certification of the commitment to offer only compliant products or services. The Operator may suspend the ads of professionals who do not provide this information within the communicated deadline.

12.5. Each user is responsible for fulfilling their tax obligations, including the declaration and payment of taxes and contributions related to income obtained from activities announced on the platform. The Operator does not withhold or declare taxes on behalf of users. To the extent that the platform falls under the reporting obligations provided for in Annex no. 5 to Law no. 207/2015 (DAC7), the Operator will collect and report the information required by law, and users will provide the requested data.

Art. 13. Job listings

13.1. The job listing indicates the nature of the activity, the place of performance, the type of contract, the work schedule, the remuneration or remuneration range and, when the employer is a professional, their name.

13.2. The publication of discriminatory criteria is prohibited, including requirements related to age, sex, marital status, pregnancy, ethnic or religious affiliation, except in cases where the law permits differential treatment based on an essential and decisive occupational requirement.

13.3. Persons carrying out employment mediation activities abroad for Romanian citizens have the obligations provided by Law no. 156/2000 regarding the protection of Romanian citizens working abroad, including registration obligations and not charging commissions to the job seeker. Users who publish job placement ads declare that they meet these conditions. The Operator does not carry out mediation activities and does not charge amounts from job seekers.

13.4. It is forbidden to request, through an ad or message, advance payments from candidates, under any title, including for job reservation, for formalities, for accommodation or for transport.

13.5. Employers falling under the rules on pay transparency, in particular Directive (EU) 2023/970 and national transposition acts, shall comply with the applicable obligations regarding the indication of the remuneration level or range in the recruitment notice.

13.6. Candidates transmit personal data directly to the employer. From that moment on, the employer becomes an independent controller with respect to such data.

Art. 14. Housing advertisements

14.1. The advertisement shall indicate the type of housing, the locality and area, the surface area, the rent, the estimated additional expenses, the requested security deposit, and availability.

14.2. The user publishing the advertisement declares that they have the right to rent or sublet the space and that they comply with the applicable legal conditions in the state where the property is located, including those regarding subletting, the maximum number of persons, safety standards, and registration obligations.

14.3. It is forbidden to request a sum of money before viewing the housing and signing the contract, as well as to condition the viewing on the payment of an advance. Advertisements requesting money transfers to persons located in another country, under the pretext of reservation, are removed.

14.4. Lease agreements are subject to the law of the state where the property is located. For properties located in Romania, the provisions of the Civil Code regarding lease and, where applicable, Housing Law no. 114/1996 apply, including the obligations to register the contract with the tax authority.

14.5. In the case of short-term tourist rentals, hosts comply with Regulation (EU) 2024/1028 on the collection and sharing of data relating to short-term accommodation rental services, applicable from May 20, 2026, including the obligation to hold and display the registration number, where the Member State has established a registration procedure. The Operator may request the indication of this number in the listing and may remove listings that do not contain it, to the extent that the platform qualifies as an online short-term rental platform within the meaning of the regulation.

Art. 15. Service listings

15.1. The provider indicates the nature of the service, the covered geographical area, the fee or the method for calculating it and, if acting as a professional, the identification data.

15.2. Services that require a qualification or authorization, such as medical, dental, physiotherapy, legal, accounting, authorized translation, electrical, gas, or construction installation services, may only be offered by persons holding the qualifications and authorizations required by the State where the service is provided. The User is responsible for holding them and presents them upon request.

15.3. Professional providers issue tax documents for the services provided and comply with consumer protection obligations, including pre-contractual information and, in the case of distance or off-premises contracts, the right of withdrawal.

Art. 16. Events

16.1. The organizer indicates the name of the event, the date, time, location, conditions of participation and the price, if any.

16.2. The organizer is responsible for obtaining the necessary authorizations, for complying with safety conditions and for correctly informing the participants. The Operator does not organize, co-organize, or guarantee the holding of the announced events.

Art. 17. Passenger and parcel transport

17.1. Secțiunea Transport permite publicarea de oferte de cursă, de cereri de transport pentru persoane și de oferte sau cereri de transport de colete între țări.

17.2. Utilizatorul care publică o ofertă de transport declară și garantează că:

1. deține permisul de conducere valabil și, dacă este cazul, atestatul profesional cerut de lege;

2. vehiculul este înmatriculat, este în stare tehnică corespunzătoare, are inspecția tehnică periodică valabilă și este asigurat prin asigurare obligatorie de răspundere civilă auto, valabilă pe teritoriile tranzitate;

3. atunci când transportul are caracter comercial, deține licența de transport, licența comunitară și celelalte documente prevăzute de Regulamentul (CE) nr. 1071/2009, de Regulamentul (CE) nr. 1072/2009 și de Regulamentul (CE) nr. 1073/2009, precum și de legislația națională aplicabilă, respectiv Ordonanța Guvernului nr. 27/2011 privind transporturile rutiere;

4. respectă normele privind timpul de conducere și perioadele de odihnă, prevăzute de Regulamentul (CE) nr. 561/2006, atunci când acestea se aplică;

17.4. Pentru transportul de colete:

1. the sender correctly declares the contents, weight and value of the package and is responsible for the accuracy of the declaration;

2. the transport of goods whose circulation is prohibited or restricted is forbidden: narcotic substances, weapons, ammunition, explosive or flammable materials, counterfeit products, live animals without the required documents, large undeclared sums of cash, excisable goods above the permitted limits, identity documents of other persons;

3. transport between a Member State of the European Union and a third country, including Switzerland, is subject to the applicable customs regulations. Customs declaration, payment of any taxes and compliance with quantitative limits are the responsibility of the sender and the carrier. Cash amounts of EUR 10,000 or more entering or leaving the Union must be declared in accordance with Regulation (EU) 2018/1672;

4. professional parcel transport may fall under the scope of postal services legislation and Regulation (EU) 2018/644 on cross-border parcel delivery services. The user shall check whether authorization obligations apply to them.

17.5. The transport contract is concluded directly between users. The Operator is not a carrier, does not issue tickets, does not collect the price of the trip and is not responsible for cancellations, delays, loss or damage to packages, accidents or damages of any kind arising in connection with the travel. Regulation (EU) No 181/2011 concerning the rights of passengers in bus and coach transport applies, where applicable, to the carrier and not to the Operator.

17.6. We recommend that you check the identity and documents of the other party before traveling, agree in writing on the conditions and not transport packages whose contents have not been shown to you.

Art. 18. Posts on the community feed

18.1. The community feed is intended for the exchange of information and recommendations between members. Posts must comply with the rules in Article 9.

18.2. Recommendations regarding individuals, practices, stores, or service providers express the author's opinion. The operator does not verify them and is not responsible for their accuracy. Statements that harm the reputation of a person or entity may incur the author's liability.

18.3. Posts requesting assistance in medical, legal, or safety emergency situations do not replace calling the competent services. In case of an emergency, call 112 in the European Union, 112 or 144 in Switzerland, or the emergency number of the country you are in.

Art. 18^1. Audio and video calls between users

What the service is

18¹.1. The platform allows registered users to initiate and receive audio and video calls between accounts via an internet connection, without using phone numbers and without interconnection with public telephone networks.

18¹.2. From a legal perspective, the functionality constitutes a number-independent interpersonal communications service, within the meaning of Article 4 point 4 letter b) of Government Emergency Ordinance no. 111/2011 on electronic communications, as amended by Law no. 198/2022, which transposes the European Electronic Communications Code. Such services are not subject to the general authorization regime applicable to providers of electronic communications networks and services, but remain subject to obligations regarding the security and confidentiality of communications.

Calls do not replace emergency services

18¹.3. The calling functionality does not allow calling emergency numbers and does not ensure the caller's location. In case of emergency, use your phone and call 112 in Romania and the European Union, 112 or 144 in Switzerland, or the emergency number in the state you are in. Calls through the platform depend on your internet connection and the functioning of your device and may not be available in case of a power outage, connection interruption, or service unavailability.

Consent and access to microphone and camera

18¹.4. Initiating or accepting a call requires granting permission to access the microphone and, for video calls, the camera, at the browser or operating system level. You can revoke permission at any time from your device settings. Revocation prevents the use of the functionality without affecting other services.

18¹.5. Calls can only be initiated from open conversations between users: a user can only call you from an existing message thread with you, and in conversations related to a transport ride only after accepting the ride. Blocking a user (paragraph 18¹.10) prevents calls from that user. As of the date of this version, there is no separate setting to completely disable receiving calls.

Privacy and prohibition of recording

18¹.6. Accepted calls are recorded by the Operator (audio and, in video calls, video), under the conditions of paragraph 18¹.6¹, along with the metadata described in the Information Note, namely the participants, time, duration, call status, and the context from which it originated, as well as the technical logs necessary for operation. The Operator does not listen to, transcribe, or analyze the content of calls on a regular basis; access to recordings is limited to specific cases and authorized persons described in article 29¹.

18¹.6¹. The call recording functionality is active as of the date of this version, for all accepted calls; the recording starts at the moment the called party accepts the call. The following rules apply:

1. participants are informed about the call recording, its purpose and the retention period through this article and through the Privacy Notice (section V bis.4), brought to their attention before using the functionality;

2. by accepting these Terms and by initiating or accepting a call, participants agree to its recording; a participant who does not wish to be recorded may decline the call or use written messaging;

3. the recording stops when the call is ended by either participant;

4. the purposes are those provided in section V bis.2 of the Privacy Notice, namely platform security, resolution of reported incidents, and defense of legal rights;

5. the retention period is the one indicated in the Privacy Notice, section X.

18¹.7. Apart from the functionality provided by the Operator, it is forbidden to record, screen-grab, broadcast, or retransmit a call without the prior consent of all participants. Unauthorized recording of a private conversation may constitute an offense, in particular according to articles 226 and 302 of the Romanian Criminal Code, and may attract similar sanctions in other jurisdictions. When a participant is in Switzerland, article 179 et seq. of the Swiss Criminal Code also applies, which penalizes the recording of conversations without the participants' consent.

18¹.8. The confidentiality of communications is protected by article 3 of Law no. 506/2004. The regime of the Operator's access to the content of communications, their conservation and disclosure is provided in article 29¹ and detailed in section V bis of the Privacy Notice.

Conduct during calls

18¹.9. The rules under Article 9 apply fully to calls as well. The following are specifically prohibited: unwanted repeated calls after the recipient has refused contact; sending unsolicited sexually explicit images; threats, insults, and harassment; calls made for the purpose of fraud, including by invoking a false identity, a fictitious emergency, or an offer requiring immediate payment; contacting minors by persons who do not know them, for purposes that contravene their safety.

18¹.10. You can block a user, which prevents calls and messages from being initiated to you, and you can report an abusive call through the mechanism available at the end of the call or in the call history. Reporting generates a complaint handled in accordance with Articles 27-29.

18¹.11. Since calls are private communications and not publicly disseminated content, the Operator cannot moderate them in real-time and cannot verify what is being discussed. Measures can only be taken based on received reports and available metadata. For this reason, prevention largely depends on your own caution: do not accept video calls from unknown persons if you do not wish to, do not disclose banking details, codes received via SMS, or identity documents during a call, and do not follow up on requests for urgent payment.

Technical aspects and liability

18¹.12. The connection is established via WebRTC technology or equivalent technology. Depending on the network configuration, the connection can be direct between the participants' devices, in which case a participant's IP address may become visible to the other. Details are described in the Privacy Notice.

18¹.13. The data traffic generated by calls is consumed from your internet subscription, and the associated costs, including roaming costs, are your responsibility.

18¹.14. The operator does not guarantee the quality, continuity or availability of calls, as these depend on factors outside its control, such as the participants' internet connection, the devices used and intermediate networks.

18¹.15. The call service is provided free of charge. The operator is not liable for the content of the discussions, for the agreements made during the calls and for the damages resulting from them.

CHAPTER IV^1. ACTIVITIES CARRIED OUT OUTSIDE ROMANIA

Art. 18^2. Scope of this chapter

18².1. The operator is established in Romania. The platform is available in Romanian and is addressed to the community of Romanians settled abroad, without being directed at the public of a specific state.

18².2. The published listings concern, by their nature, activities carried out in other states. The user is responsible for identifying and complying with the rules applicable to their activity in the state where it is carried out, regardless of whether that state is a member of the European Union or not.

18².3. This chapter contains, for informational purposes, the obligations most frequently encountered in the practice of the platform's users. They are presented with reference to Switzerland, the state where most of the advertised activities are located at this stage. The enumeration is not exhaustive, does not replace legal advice and does not limit the obligations of users operating in other states, to whom the principle from the previous paragraph applies by analogy.

18².4. Switzerland is not a member state of the European Union and is not part of the European Economic Area. Union law does not apply directly on its territory, except in areas regulated by bilateral agreements. Users must not assume that European rules invoked in this document produce effects in Switzerland.

Art. 18^3. Job listings for positions in Switzerland

18³.1. Employers recruiting for positions located in Switzerland comply with the obligation to announce vacant positions (Stellenmeldepflicht), established by Article 21a of the Federal Act on Foreign Nationals and Integration. This obligation applies to occupations with an unemployment rate of at least 5 percent, included in the list published annually by the State Secretariat for Economic Affairs. The list for the current year is available on the official page of the State Secretariat for Economic Affairs, https://www.arbeit.swiss/de/arbeitgebende/stellenmeldepflichten.

18³.2. For these occupations, the employer must first announce the position to the regional employment placement center and cannot publish it in other media, including Expatio, for five working days from the publication of the announcement in the public system. Early publication constitutes an offense and may attract penalties.

18³.3. By publishing an announcement for a position in Switzerland, you declare that you have checked whether the occupation is on the respective list and that, if so, the five working days have expired. The operator may request proof of the announcement and may remove announcements published in violation of this obligation.

18³.4. Hiring a Romanian citizen in Switzerland requires compliance with the applicable residence and work regime, under the Agreement between the European Community and its Member States and the Swiss Confederation on the free movement of persons. Employers check the candidate's residence permit and carry out the required announcement formalities for posted workers or for short-term activities.

18³.5. Salary and working conditions comply with the applicable collective labor agreements for the branch and, where applicable, the cantonal minimum wages. Announcements proposing conditions below these thresholds may be removed.

Art. 18^4. Rentals of housing located in Switzerland

18⁴.1. Subletting a residence is only permitted with the prior consent of the landlord, according to Article 262 of the Swiss Code of Obligations. The landlord may refuse consent if the tenant refuses to communicate the terms of the sublease, if they are abusive in relation to the main contract, or if the subletting causes major inconveniences.

18⁴.2. Charging a disproportionate sublease rent compared to the rent paid to the main landlord is prohibited. This practice may lead to the termination of the rental contract and, where applicable, liability for abusive rents under Article 269 of the same code.

18⁴.3. Advertisements for residences in Switzerland indicate the net rent, additional costs, the requested deposit, and the availability date. The deposit cannot exceed three monthly rents and must be deposited in a bank account opened in the tenant's name, according to Article 257e of the Swiss Code of Obligations. Advertisements requesting the transfer of the deposit to a personal account of the owner or through rapid money transfer services are prohibited.

18⁴.4. Short-term tourist rentals may be subject to cantonal or municipal restrictions and obligations for registration and payment of the lodging tax. The verification of these is the responsibility of the host.

Art. 18^5. Services provided on the territory of Switzerland

18⁵.1. Providers established in the European Union who perform work or provide services in Switzerland for a period of up to 90 working days per calendar year are required to notify their activity in advance, through the online notification procedure of the State Secretariat for Migration, respecting the eight-day deadline set by the legislation on posted workers. Exceeding the 90 days requires obtaining a permit.

18⁵.2. Providers must comply with the minimum working and salary conditions applicable in Switzerland for the activity carried out, according to the Federal Act on Posted Workers.

18⁵.3. Regulated professions in Switzerland, such as those in healthcare, high-risk construction, electrical installations, or security, may only be practiced after the recognition of qualifications or after obtaining the authorization required by Swiss or cantonal law.

Art. 18^6. Commercialization of Romanian products in Switzerland

18⁶.1. Companies offering Romanian products to users in Switzerland are responsible for compliance with applicable Swiss legislation, in particular:

1. legislation on foodstuffs and utility articles, including requirements regarding food safety, labeling in official languages, indication of allergens, expiry date and country of origin, as well as self-control obligations and notification of activity to the competent cantonal authority;

2. restrictions on the import of products of animal origin, including meat, dairy products and meat preparations, which cannot be introduced into Switzerland outside the limits and conditions provided by veterinary regulations;

3. the authorization regime for the commercialization of alcoholic beverages and restrictions on sales to minors;

4. price indication requirements provided by the Federal Ordinance on Price Indication, including the obligation to display the final price in Swiss francs, with all taxes included.

18⁶.2. The declaration of professional status provided for in Article 12.2 also applies to these users. Advertisements published by companies shall indicate the name, legal form, registered office and, where applicable, the enterprise identification number.

Art. 18^7. Transport between Switzerland and Romania

18⁷.1. Road transport of passengers and goods between the European Union and Switzerland is regulated by the Agreement of June 21, 1999 between the European Community and the Swiss Confederation on the carriage of goods and passengers by rail and road. Commercial carriers hold the authorizations provided by this agreement.

18⁷.2. Domestic transport in Switzerland carried out by foreign carriers (cabotage) is generally prohibited. The trips published on the platform cannot involve transport between two locations both situated in Switzerland, when the carrier is not authorized in this regard.

18⁷.3. Crossing the Swiss border requires compliance with customs regulations. Switzerland is not part of the customs union of the European Union. The transported goods must be declared at customs in accordance with the law. From January 1, 2025, the value limit for import without value-added tax in passenger traffic is 150 Swiss francs per person and per day. Above this value, the Swiss value-added tax is due on the entire value of the goods. Additionally, exemptions apply for quantities of food products, alcohol, and tobacco, as well as prohibitions regarding products of animal origin.

18⁷.4. Cash amounts or equivalent values of at least 10,000 Swiss francs must be declared at the request of the Swiss customs authority. Regulation (EU) 2018/1672 requires the declaration of amounts of 10,000 EUR or more when entering or exiting the Union.

18⁷.5. The sender and the carrier are responsible for the correct declaration of parcels, for the payment of due taxes, and for the consequences of non-declaration. The operator does not carry out customs formalities and is not responsible for the confiscation or retention of goods.

Art. 18^8. Tax aspects regarding promotional services sold in Switzerland

18⁸.1. Promotional services provided to clients from Switzerland are not subject to the value-added tax of the European Union, with the place of provision being considered, as a rule, at the beneficiary.

18⁸.2. The obligation to register for value added tax purposes in Elveția does not depend on directing the activity towards this state, but on the services actually provided. It may arise when the Operator provides electronic services to persons in Elveția who are not registered for tax purposes there, and the global turnover from services that would be taxable in Elveția reaches 100.000 de franci elvețieni. In this case, Swiss legislation requires the appointment of a tax representative with headquarters in Elveția. As of the date of this version, the platform does not collect payments for promotion services (see article 21.3), so the above threshold is not reached; the registration situation will be updated in this document upon the activation of payments.

18⁸.3. Prices displayed to users in Elveția are indicated in CHF/EURO/DOLAR/RON and include all taxes due, according to the requirements regarding price indication.

Art. 18^9. Data protection for users in Elveția

18⁹.1. The data processing of all users is carried out under the incidence of Regulamentului (UE) 2016/679, since the Operator is established in România. For processing concerning persons located in Elveția, the Swiss Federal Data Protection Act also applies, according to the principle of effects provided for in article 3 thereof.

18⁹.2. The appointment of a representative in Elveția constitutes a distinct obligation, which arises only if the four conditions of article 14 of the Swiss law are cumulatively met, among which is that the processing is related to the offering of goods or services to persons in Elveția. The applicability of the law and the obligation of representation have different thresholds and are not to be confused.

18⁹.3. Persons located in Switzerland may address both the National Supervisory Authority for Personal Data Processing in Romania, the competent authority in relation to the Operator, and the Swiss data protection authority, for processing activities to which Swiss law applies. The absence of a designated representative in Switzerland does not affect this latter recourse.

18⁹.4. The analysis of conditions, the up-to-date situation, and the representative's data, when designated, can be found in section IX bis of the Information Note.

CHAPTER V. REVIEWS AND REPUTATION

Art. 19. The Review System

19.1. Users can review each other after an interaction by granting a rating and, optionally, a comment.

19.2. Reviews must reflect a real experience. Fake reviews, reviews granted in exchange for an advantage, reciprocal reviews agreed upon for the artificial increase of reputation, and reviews granted by accounts controlled by the same person are prohibited.

19.3. The Operator applies reasonable and proportionate measures to verify whether reviews come from users who have actually used the service, in accordance with the obligation provided in article 6 paragraph (1) of Government Emergency Ordinance no. 34/2014, as amended. These measures consist of confirming the interaction by both parties, automatic verification of atypical patterns, and the removal of flagged reviews.

19.4. The Operator does not publish fake reviews and does not commission third parties to publish such reviews.

19.5. The review may be removed if it violates platform rules. The reviewed person can publicly respond to a review and can notify the Operator according to the procedure in article 27.

19.6. The displayed rating is calculated as the average of the reviews received while using the platform and can be weighted according to the number of interactions. The calculation method is described at https://expatio.ai/ajutor.

CHAPTER VI. PAID PROMOTION OF LISTINGS

Art. 20. Purpose of the service

20.1. The only paid service provided by the Operator is the promotion of listings, respectively their display with additional visibility on the main feed and within categories, for a determined period.

20.2. Promoted listings are displayed with the label “Sponsorizat” or with an equivalent, visible and legible mention, so that users can distinguish paid content from unpaid content. This obligation derives from Article 26 of Regulation (EU) 2022/2065 and from the provisions regarding unfair commercial practices.

20.3. Promotion influences the display position of the listing, but does not guarantee a certain number of views, contacts or the completion of a transaction, unless the purchased package expressly provides otherwise.

20.4. Promotion does not modify the content of the listing and does not exempt it from the rules in this document. A promoted listing that violates the rules is removed, and in this case Article 24 applies.

Art. 21. Price, order and payment

21.1. The available promotion packages, the duration and the price of each are displayed on the platform, on the listing promotion screen, at the time of activating the paid service. Prices are expressed in EUR and include value added tax, when due. For professional buyers registered for VAT purposes in another member state, the reverse charge mechanism applies, if the legal conditions are met.

21.2. The order is placed by selecting the package, verifying the data and confirming via the button that expressly indicates the payment obligation. The contract is considered concluded at the moment of payment confirmation by the payment processor and the transmission of confirmation by the Operator via e-mail.

21.3. Payment is made through the instruments made available within the platform. At the date of the current version, the platform does not collect payments and does not issue invoices; at the time of activation of payments, they will be processed by Viva Wallet (Viva Payment Services S.A., European Union). The operator does not have access to the complete data of the payment instrument.

21.4. The invoice is issued in electronic format and sent to the e-mail address associated with the account, within 3 days from the collection. For operations that fall under the incidence of the reporting obligation in the national RO e-Factura system, the invoice is also transmitted through this system, according to Government Emergency Ordinance no. 120/2021 and subsequent acts.

21.5. Promotion begins immediately after payment confirmation and runs for the chosen period.

Art. 22. Consumer's right of withdrawal

22.1. The consumer who purchases a promotion service benefits from the right to withdraw from the contract within 14 days from the date of its conclusion, without having to justify the decision and without incurring other costs than those provided by law, according to articles 9 and following of Government Emergency Ordinance no. 34/2014.

22.2. To exercise the right of withdrawal, send an unequivocal statement to [email protected] or use the standard form in the annex to this section. The deadline is considered met if the statement is sent before the expiration of the 14 days.

22.3. If you request that the provision begin before the expiration of the withdrawal period, you will be obliged, in case of withdrawal, to pay the countervalue of the services provided until the moment of communicating the decision, proportional to the service performed, according to article 14 paragraph (3) of Government Emergency Ordinance no. 34/2014.

22.4. The consumer loses the right of withdrawal after the full execution of the service, if the execution began with their prior express consent and after confirming that they have acknowledged the loss of the right of withdrawal upon full execution, in accordance with article 16 letter a) of the same normative act. The Platform requests this consent and confirmation before the start of the promotion.

22.5. The amounts owed shall be refunded within a maximum of 14 days from the date on which the Operator is informed about the withdrawal decision, using the same payment methods as those used for the initial transaction, unless you agree otherwise.

22.6. The right of withdrawal does not apply to users acting in a professional capacity.

Standard withdrawal form (to be filled in and transmitted only if you wish to withdraw from the contract):

To MED TIMES ONLINE S.R.L., Bucuresti, Sectorul 3, Bd. Poet Octavian Goga Nr 4, Bloc M26 scara 3 Ap 60 camera 1, [email protected]. I hereby inform you regarding my withdrawal from the contract having as its object the provision of the following service: [description of the promotion service]. Ordered on [date] / Order number: [number] Consumer name: [name] Consumer address: [address] Signature (only in the case of transmission on paper): [signature] Date: [date]

Art. 23. Non-execution of the promotion service

23.1. If the promotion is not delivered for reasons attributable to the Operator, you will receive, at your choice, the extension of the promotion period by the unexecuted duration or the proportional refund of the price.

23.2. Complaints regarding the promotion service shall be sent to [email protected], within 30 days from the end of the promotion period, and shall be resolved within 30 days.

23.3. Consumers benefit from the legal guarantee of conformity for digital services, under the conditions of Emergency Ordinance no. 141/2021 regarding certain aspects concerning contracts for the supply of digital content and digital services.

Art. 24. Suspension of promotion

24.1. The operator may suspend or terminate the promotion of an ad that violates the law or these Terms. In this case, the price corresponding to the remaining period is refunded only if the violation is not attributable to you.

24.2. The measure is communicated to you together with the reasons underlying it and the indication of the appeal channels.

CHAPTER VII. CONTENT RANKING AND ADVERTISING

Art. 25. Ranking parameters

25.1. The order in which posts and ads are displayed is determined mainly by the following parameters:

1. publication date and content topicality;

2. correspondence with search terms and applied filters;

3. geographic proximity to the declared locality or to the detected position, when you have enabled location;

4. selected category;

5. existence of a valid paid promotion;

6. account quality signals, such as received ratings, account age, and the absence of moderation measures;

7. your previous interactions with similar content;

8. ad completeness.

25.2. The existence of a payment directly influences the display position of promoted ads. This mention is made in the execution of article 6 paragraph (1) of Government Emergency Ordinance no. 34/2014, as amended by Government Emergency Ordinance no. 58/2022, and of article 27 of Regulation (EU) 2022/2065.

25.3. You can influence the display order by using the filters and sorting options available in the interface, including chronological sorting when it is made available.

Art. 26. Advertising

26.1. The advertising displayed on the platform is identified as such, indicating the person on whose behalf it is presented, when this differs from the person who paid for the display, as well as significant information regarding the main parameters used to determine the recipient to whom the ad is presented.

26.2. We do not display advertising based on profiling using special categories of data provided for in Article 9 paragraph (1) of the GDPR and we do not display advertising based on profiling when we know with reasonable certainty that the recipient is a minor, in accordance with Articles 26 paragraphs (3) and (4) of Regulation (EU) 2022/2065.

CHAPTER VIII. MODERATION, REPORTS AND MEASURES

Art. 27. Notification of illegal content

27.1. Any person can report content they consider illegal, through the mechanism available on the platform for each post and announcement or by e-mail at [email protected]. The mechanism implements Article 16 of Regulation (EU) 2022/2065.

27.2. The notification includes: a sufficiently substantiated explanation of the reasons why the content is considered illegal; the exact web address of the content; the name and e-mail address of the notifier, except for notifications regarding crimes against the freedom and sexual integrity of minors; a statement of good-faith belief that the information is accurate and complete.

27.3. We confirm receipt of the notification without delay and communicate the decision taken, along with its justification, as well as information regarding remedies.

27.4. Notifications that allow a diligent provider to ascertain the illegal nature without detailed legal examination give rise to actual knowledge, within the meaning of Article 6 of Regulation (EU) 2022/2065 and Articles 14 and 15 of Law no. 365/2002.

27.5. Notifications submitted by trusted signalers designated in accordance with Article 22 of Regulation (EU) 2022/2065 are handled with priority.

Art. 28. The measures we can take

28.1. In case of violation of the law or of these Terms, we may take, depending on the severity, one or more of the following measures:

1. removing the content or blocking access to it;

2. demoting or limiting the visibility of the content;

3. warning addressed to the account holder;

4. temporary suspension of the ability to publish;

5. temporary suspension of the account;

6. termination of service provision and account closure;

7. suspension of the processing of notifications and complaints submitted by persons who abuse these mechanisms.

28.2. The measures are applied diligently, objectively and proportionally, taking into account the rights and legitimate interests of all parties, including freedom of expression.

28.3. Accounts that frequently provide manifestly illegal content may be suspended for a reasonable period, after issuing a prior warning, in accordance with Article 23 of Regulation (EU) 2022/2065.

Art. 29. Motivation and contestation of decisions

29.1. We communicate to the account holder a clear statement of reasons for any applied restriction, indicating the facts and circumstances considered, the contractual or legal basis, the manner in which the content was identified and the available remedies.

29.2. You can contest the decision within 6 months of communication, through the internal complaint handling mechanism, by sending a request to [email protected]. The complaint is resolved within 14 working days, under the supervision of a staff member, and not exclusively through automated means. The reasoned decision is communicated to you.

29.3. You have the right to choose an out-of-court dispute settlement body certified by the Digital Services Coordinator, in accordance with Article 21 of Regulation (EU) 2022/2065. The list of certified bodies in Romania is published by the National Authority for Management and Regulation in Communications.

29.4. These procedures do not affect your right to address the courts.

Art. 29^1. Access to private communications and data retention

29¹.1. Chat messages and calls between users are private communications. The operator does not access them discretionarily and does not perform generalized human reading of conversations for purposes of curiosity, general surveillance, or individualized commercial analysis.

29¹.2. The operator may access the content of a communication when this is necessary for one of the following purposes: service administration; platform safety; prevention and investigation of fraud, abuse, and unauthorized or illegal use of services; investigation of a reported incident; resolution of a complaint or a dispute between users; establishment, exercise, or defense of legal rights; fulfillment of a legal obligation.

29¹.3. Access respects the following limits:

1. is usually triggered by a notification, a complaint, an incident, or a legal request;

2. concerns the conversation thread or call relevant to the specific case, rather than the user's entire history;

3. is granted only to authorized persons, on a role basis;

4. is recorded in an access log indicating the person, time, subject, and reason.

29¹.4. The operator does not retain user communications for the purpose of making them generally and proactively available to law enforcement authorities. Cooperation with the authorities takes place in individual cases, under the conditions of Article 30.

29¹.5. In the event of a complaint, incident, dispute or legal request, strictly relevant data may be kept beyond the usual retention period, for the duration necessary for the investigation, resolution or exercise or defense of legal rights. The retention measure concerns the relevant thread, call or segment, is established punctually and is lifted upon the closure of the case, unless another legal reason for retention persists.

29¹.6. The retention periods applicable to messages, call recordings and data retained for a specific case are distinct and are indicated in the Information Notice.

29¹.7. Proactive and generalized verification of private communications is not carried out by the Operator and cannot be required of it. Article 8 of Regulation (EU) 2022/2065 prohibits the imposition of a general monitoring obligation. According to Article 7 of the same regulation, voluntary investigations carried out by the Operator on its own initiative, under the conditions of this article, do not deprive it of the exemptions from liability provided for in Article 6.

Art. 30. Requests and orders of authorities

30.1. Upon receipt of an order to act against illegal content or a request for information issued by a competent authority, the Operator complies with them under the conditions of Articles 9 and 10 of Regulation (EU) 2022/2065 and Law no. 50/2024 and informs the authority about the measures taken.

30.2. The Operator discloses data to authorities only when disclosure is required or permitted by applicable law, based on a valid legal request, a court order, a legal obligation or, in individual cases, when disclosure is necessary and permitted for reporting potential criminal acts or threats to public safety.

30.3. Each request is verified as to the issuing authority and its competence, the legal basis, the form and reasoning, the territorial scope and proportionality. Requests that do not meet these requirements are challenged or returned for clarification. Only data necessary and relevant for the purpose of the request are transmitted.

30.4. Requests originating from authorities in states outside the European Union and the European Economic Area are analyzed separately, regarding the existence of a basis recognized by Union law and the fulfillment of the requirements regarding international transfers provided in chapter V of GDPR.

30.5. The preservation of computer data may be ordered under the conditions of article 154 of the Code of Criminal Procedure, and their surrender under the conditions of article 170 of the same code. The interception of communications can only be carried out within the framework of technical surveillance procedures authorized by a judge, in which the Operator does not participate of its own initiative.

30.6. Regulation (EU) 2023/1543 on European Production and Preservation Orders for electronic evidence in criminal matters applies from 18 august 2026, together with Directive (UE) 2023/1544. The Operator receives such orders at the designated headquarters indicated in article 1.2 and responds within the deadlines provided by the regulation.

30.7. The targeted user is informed about the order received and the measure taken, at the latest at the time of execution, unless the authority orders otherwise for reasons of public order or safety.

Art. 31. Suspicions of crimes

31.1. If we become aware of information leading to the suspicion that a crime involving a threat to the life or safety of a person has been committed, is being committed, or is likely to be committed, we immediately inform the competent authorities, in accordance with article 18 of Regulation (EU) 2022/2065.

CHAPTER IX. LIABILITY

Art. 32. Liability of the Operator

32.1. The Operator is not liable for information stored at the request of users, provided it has no actual knowledge of illegal activity or content and acts expeditiously to remove it upon obtaining such knowledge, in accordance with Article 6 of Regulation (EU) 2022/2065 and Article 14 of Law no. 365/2002. The Operator has no general obligation to monitor the information it stores, in accordance with Article 8 of the same regulation.

32.2. The Operator is not liable for:

1. the accuracy, legality, quality or timeliness of content published by users;

2. the conclusion, performance or non-performance of agreements between users;

3. damages resulting from interactions between users, including those produced during a trip, a service provision or a viewing;

4. the loss, damage or confiscation of packages transported by users;

5. the conduct of users outside the platform;

6. the content of third-party websites to which links exist;

7. the content of audio and video calls, their quality and the consequences of agreements reached during them;

8. compliance by users with the Swiss regulations mentioned in chapter IV¹, the verification of these falling upon each user.

32.3. The Operator makes reasonable efforts to maintain the availability of the platform, without guaranteeing uninterrupted or error-free operation. The Service may be interrupted for maintenance work, updates or for technical reasons. We announce planned interruptions in advance, when possible.

32.4. In relations with professional users, the Operator's liability for the promotion service is limited to the equivalent value of the amounts paid by the user in the last 12 months for the service in connection with which the damage occurred. The Operator is not liable for unrealized profit, loss of clientele or indirect damages.

32.5. The limitations from the preceding paragraph do not apply in case of intent or gross negligence, in case of injury to bodily integrity or health, in the case of liability that cannot be limited according to the law and in relations with consumers, to the extent that mandatory law prohibits such a limitation. No provision in this document removes the rights that consumer protection legislation grants to consumers.

Art. 33. User liability

33.1. You are responsible for the published content, for the statements made and for compliance with the legal obligations incumbent upon you in connection with the advertised activity.

33.2. If a third party makes claims against the Operator as a result of the content published by you or your violation of these Terms, you will indemnify the Operator for the amounts it is obliged to pay by a final court decision or settlement, as well as for reasonable defense expenses, provided that the Operator informs you without delay about the claim and allows you to participate in the defense.

CHAPTER X. DURATION, AMENDMENT AND TERMINATION

Art. 34. Duration

34.1. The contract is concluded for an indefinite period and produces effects until the closure of the account or until its termination under the conditions of this chapter.

Art. 35. Amendment of the Terms

35.1. The Operator may modify these Terms to reflect changes in functionalities, the legal framework or its practices.

35.2. Modifications are communicated by e-mail and through a visible notification in the platform, at least 15 days before their entry into force, in accordance with Article 14 paragraph (2) of Regulation (EU) 2022/2065. For modifications concerning professional users and falling under Regulation (EU) 2019/1150, the notice period is at least 15 days or longer, if necessary for technical or commercial adaptations. Regulation (EU) 2019/1150 applies to business users established in the Union who offer goods or services to consumers located in the Union. The Operator applies the same notice period to business users established in Switzerland, although they do not fall within the scope of the regulation.

35.3. If you do not accept the modifications, you can close your account before the date of their entry into force. Continued use of the platform after this date constitutes acceptance.

35.4. Modifications do not apply retroactively to promotion orders already paid for.

Art. 36. Termination

36.1. You can terminate the contract at any time by closing your account.

36.2. The Operator may terminate the contract with a 30-day notice, sent by e-mail, without having to justify the decision, with the refund of amounts paid for unperformed services.

36.3. The Operator may terminate the contract without notice, with immediate effect, in case of a serious breach of these Terms, use of the platform for illicit purposes, fraud, or when a legal obligation requires it. The reasons are communicated to the user, in accordance with Article 29.

36.4. Termination does not affect clauses which, by their nature, survive, in particular those regarding liability, intellectual property, confidentiality, applicable law and dispute resolution.

CHAPTER XI. COMPLAINTS AND DISPUTES

Art. 37. Complaints

37.1. Complaints regarding the services provided by the Operator shall be sent to [email protected] or, in writing, to the registered office. We will respond within 30 days of receipt.

37.2. Complaints regarding the conduct of other users shall be transmitted through the reporting mechanism described in Article 27.

Art. 38. Alternative Dispute Resolution

38.1. Consumers may resort to the alternative dispute resolution procedures provided by Government Ordinance no. 38/2015 on alternative dispute resolution between consumers and traders, by addressing the Alternative Dispute Resolution Directorate within the National Authority for Consumer Protection or another alternative dispute resolution entity registered in the national register.

38.2. The European Online Dispute Resolution platform ceased its activity on July 20, 2025, following the repeal of Regulation (EU) No 524/2013. References to it in other documents no longer produce effects.

38.3. Consumers may also address the National Authority for Consumer Protection, via the platform available at anpc.ro, as well as the European Consumer Centre in Romania, for cross-border disputes.

38.4. Consumers residing in Switzerland may seek support from the Swiss Consumer Protection Foundation (Stiftung für Konsumentenschutz / Fédération romande des consommateurs), or the Swiss Consumer Information Bureau, respectively. Switzerland does not participate in the network of European Consumer Centres, and the alternative dispute resolution mechanisms provided by Government Ordinance no. 38/2015 are not directly accessible to them. Complaints addressed to the Operator shall be resolved under the same conditions, regardless of the consumer's state of residence.

Art. 39. Applicable Law and Competent Courts

39.1. These Terms are governed by Romanian law.

39.2. The choice of law does not deprive the consumer of the protection granted by the mandatory provisions of the law of the state in which they have their habitual residence, under the conditions of Article 6 of Regulation (EC) No 593/2008 on the law applicable to contractual obligations, respectively when the Operator carries out its activity in that state or directs its activity to that state.

39.2¹. The mere accessibility of the platform from a certain state does not constitute, in itself, the direction of the activity towards that state. According to the jurisprudence of the Court of Justice of the European Union (judgment of December 7, 2010, joined cases C-585/08 Pammer and C-144/09 Hotel Alpenhof), the direction is assessed on the basis of indications such as the use of a language or a currency different from those usual in the merchant's state, the domain name, the mention of an international clientele, paid advertising targeted at a certain public and the description of access itineraries. The same criteria are used for the application of Article 17 paragraph (1) letter c) of Regulation (EU) No 1215/2012 and of Article 15 paragraph (1) letter c) of the Lugano Convention.

39.3. Disputes shall be resolved by the competent courts at the Operator's headquarters. The consumer may bring an action against the Operator either before the courts in Romania or before the courts in the Member State where they are domiciled, and the action against the consumer may be brought only before the courts in the Member State where they are domiciled, in accordance with Articles 17-19 of Regulation (EU) No 1215/2012.

Art. 41. Clauze neuzuale

41.1. The User declares that they have read and expressly accept the clauses regarding the limitation of the Operator's liability (Art. 32), the suspension and termination of the account (Art. 28 and 36), the unilateral modification of the Terms (Art. 35), the indemnification obligation (Art. 33), and the choice of the competent court (Art. 39), within the meaning of Article 1203 of the Civil Code. These clauses apply to professional users; with respect to consumers, they produce effects only to the extent that they do not contravene the provisions of Law no. 193/2000 regarding unfair terms in contracts concluded between professionals and consumers.

Art. 42. Other provisions

42.1. If a clause is declared null or inapplicable, the other clauses remain in force, and the affected clause shall be replaced with a provision that comes closest to the pursued economic purpose.

42.2. The non-exercise of a right by the Operator does not constitute a waiver thereof.

42.3. You cannot assign the rights and obligations arising from this contract without the written consent of the Operator. The Operator may assign the contract in the event of a reorganization or business transfer, with prior notification to the users.

42.4. Communications shall be made by e-mail, at the addresses indicated by the parties, and through platform notifications. The communication is considered received on the working day following its transmission.

42.5. Neither party is liable for non-performance caused by force majeure or fortuitous events, under the conditions of Article 1351 of the Civil Code, with the obligation to notify the other party within 5 days of the occurrence of the event.

42.6. These Terms, together with the documents they refer to, represent the entire agreement between the parties regarding the use of the platform.
